un reto para Costa Rica

Resumen
Al ser el Derecho Notarial una de las ramas del Derecho con más antigüedad, es necesario
el notariado tan antiguo, es necesario estudiar sobre él, su impacto y la necesidad de
entrelazarlo con los avances sociales y tecnológicos, esto para que surta efecto positivo
en la sociedad y en sus actos. La sociedad se ha ido modernizando y el notariado, en cierta
forma, ha demostrado avances; sin embargo, a nivel país no se cuenta con una digitalización
tan adelantada que permita que todas las actuaciones notariales se efectúen mediante
métodos tecnológicos que validen la información que se impregna en un papel. Existe en el
extranjero, al marco del Derecho Comparado y en este ámbito legal, un gran avance referente
a la digitalización en actos notariales o documentaciones emitidas por notarios públicos, por
lo que Costa Rica debería implementar estos mecanismos, abrazar y hacer propias algunas de
las características del notariado o el ejercicio de la función notarial en el extranjero, con la
de la gran contribución que se le generaría al ambiente con la reducción de documentación
positiva de los avances que la tecnología presenta.

Abstract
Notarial Law being one of the oldest branches of law, it is necessary to delve into its study and
to study about it, its impact and the need to intertwine it with social and technological
advances, so that it has a positive effect on society and on its own actions. Society has
been advanced and notarization has, in a certain way, been modernized, however, at the
country level there is not such an advanced digitization that allows all notarial actions to
incorporating technological methods that validate the information that is impregnated on
a great advance regarding the digitization of notarial acts or documents issued by notaries
public, so Costa Rica should implement these mechanisms, embrace and make some of the
characteristics of the Notary Public or the exercise of the notarial function abroad, in order
to progress and advance as a society, in addition to becoming aware of the great contribution
that would be generated to the environment with the reduction of physical documentation
and maximization of digital documentation, duly signed and validated. It is because of the
above that the need arises to study what the Notary Public confers and the application of
the digital signature, in order to intertwine or link the issues and then achieve a positive
application of the advances that technology presents.
